Should all shops in Upper Hutt have the option to trade on Easter Sunday?
Consultation on whether the Council should adopt an Easter Sunday trading policy in Upper Hutt has now closed.

Recent consideration of Easter Sunday trading
On 20 September 2017, Council considered recent feedback from the community on whether or not to allow more shops to open on Easter Sunday in Upper Hutt. Council is consulting on an Easter Sunday shop trading policy which would enable all shops in the city to choose whether or not to trade on Easter Sunday.
In adopting an Easter Sunday trading policy for consultation, Council is acting under the Shop Trading Hours Act 1990 which gives Council the discretion to introduce a policy for the whole city or parts of Upper Hutt.
Community consultation on Easter Sunday trading
Council wishes to enable the community to be an integral part of a decision about whether to give shops an option to trade on Easter Sunday. Council values the community’s feedback on the proposal to introduce an Easter Sunday trading policy in Upper Hutt.
Council is seeking feedback from the community on the preferred option of adopting an Easter Sunday trading policy for all shops in the city. You can read more about Council’s available options in the Statement of Proposal.
To be clear, if a policy is adopted, Easter Sunday trading would be enabled, and local shops covered by the policy could make their own decision to open or not on Easter Sunday. This policy would relate only to Easter Sunday trading and not to other public holidays over Easter (i.e. Good Friday and Easter Monday).
If a policy is not adopted, the existing rules under the Shop Trading Hours Act would apply. These rules only allow some shops to open on Easter Sunday, such as, food outlets, service stations and dairies. Supermarkets and other retailers must remain closed on Easter Sunday.
When would a policy need to be in place?
To potentially introduce a new Easter Sunday trading policy in time for Easter 2018, the policy must be in place by December 2017. This would allow time for shops to plan and work with their employees on how they might implement a policy. To be clear, if a shop chooses to open employees would be able to choose to work on Easter Sunday or not and this would be negotiated between the employer and employee.
Future Council processes
There will be an opportunity for the public to speak directly to the mayor and councillors at a meeting on 9 November 2017. If you wish to take up this opportunity, please tick the box in the relevant part of the submission form which is included in the link above.
All feedback (including oral submissions) will be reported to the 29 November Policy Committee meeting. The Committee will then make a recommendation to Council as to whether to introduce a new policy allowing wider Easter Sunday trading or to leave things as they are. Council will make a decision on the matter at its meeting on 13 December 2017.

Section 5A of the Shop Trading Hours Act introduced in 2016 allows councils to adopt a local Easter Sunday shop trading policy so as to allow shops to open in the whole city or defined parts of it. The Act does not allow a policy to:
- permit shops to open only for some purposes; or
- permit only some types of shops in the area to open; or
- specify times at which shops may or may not open; or
- include any other conditions as to the circumstances in which shops in the area may open.
